Protected Disclosure topics

These updates have been reviewed by Kathryn Dalziel, barrister specialising in privacy law, and employment law specialists at Anderson Lloyd. The updates reflect the new Protected Disclosures (Protection of Whistleblowers) Act 2022.

The Act has been designed to clarify the definition of serious wrongdoing and make it clear that anyone can complain to the Ombudsman at any time. There are strengthened protections for disclosers and guidance on processes for public sector organisations, which includes state schools. There are also updates about adverse conduct against a discloser, which is not permitted under the Act.

Protected Disclosure

  • These topics have been substantially updated to reflect the Protected Disclosures (Protection of Whistleblowers) Act 2022.
  • Added a note about schools making sure their employees, contractors, board members, and volunteers are aware of the school's protected disclosure procedures and how to use them. Reminders should be sent out annually. This is a requirement for public entities under the Protected Disclosures (Protection of Whistleblowers) Act 2022.
